4. SMS Terms and Conditions

4.1 Message Frequency

By opting into our SMS services, you agree to receive up to 20 messages per month, based on the back-and-forth discussions regarding your project. Actual frequency may vary depending on the scope of work and communication needs.

4.2 Potential Fees

Message and data rates may apply based on your mobile phone plan and provider. You are responsible for any costs or fees associated with receiving SMS messages.

4.3 Opt-In

To subscribe to our SMS alerts or messaging service, text “JOIN” to 832-278-2879. By opting in, you confirm that you are the authorized user of the mobile device and phone number provided.

4.4 Opt-Out

To stop receiving SMS messages from us at any time, text “STOP” to 832-278-2879. Once your opt-out request is processed, you will receive a final confirmation message, and no further SMS communications will be sent unless you choose to opt in again.

4.5 Donations

We currently do not solicit donations via SMS. Any future changes to this policy will be reflected in an updated version of these Terms.

Upon full payment for services, Writers of the West LLC transfers full ownership of the final deliverables to the client, unless otherwise agreed in writing. Until payment is made in full, Writers of the West LLC retains all intellectual property rights to the work produced.
Clients are solely responsible for ensuring that their use of our Services complies with any applicable copyright, intellectual property, or privacy laws. Writers of the West LLC shall not be liable for any claims of copyright infringement, defamation, or other legal issues arising from the client’s use of the deliverables.

6. User-Generated Content

If you submit content (e.g., manuscripts, images, testimonials) to us through the website, email, SMS, or other channels, you grant Writers of the West LLC a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, publish, and distribute such content in connection with our Services and marketing efforts for marketing deals.

Financial outcomes related to your project (e.g., book sales, royalties, or marketing impact).
Any direct, indirect, or incidental damages arising from the use of our Services, including loss of profits, opportunities, or reputation.

To the fullest extent permitted by law, Writers of the West LLC and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Services. In no event shall our cumulative liability exceed the amount paid by you, if any, for accessing or using our Services.

10. Refund Policy

While we are dedicated to ensuring your satisfaction, refunds are issued only under the following conditions:

Dissatisfaction After Revisions:
If, after receiving revisions, you remain unsatisfied with the quality of our work and have clearly communicated specific concerns that were not addressed, you may be eligible for a partial refund of the amount paid.
Repeated Late Deliveries:
In cases where deadlines are missed on multiple occasions without prior notice or agreement, you may request a partial or full refund depending on the frequency and extent of the delays.

Important Note on Quality Concerns
If the refund request is related to a lack of quality, you must communicate your concerns during the project process, allowing us the chance to address and resolve the issue. If quality dissatisfaction is not clearly communicated in a timely manner, and you suddenly decide to cancel and request a refund, no refund will be processed.

Refunds Will Not Be Issued For:

Change of scope or direction after work has commenced.
Delayed responses, lack of communication, or indecision on the client’s part.
Personal preferences or subjective changes that were not part of the original agreement.
Any other reason not explicitly related to quality or timeliness.

11. Payment Disputes

Clients agree to make payments for services rendered in accordance with the agreed-upon payment schedule. In the event of a payment dispute or chargeback, Writers of the West LLC reserves the right to pursue legal remedies and will not be liable for any losses or damages incurred as a result of the dispute.

Should a dispute arise, we encourage you to contact us directly to resolve the issue. If chargebacks are initiated without prior communication, all rights to the work provided shall immediately revert to Writers of the West LLC until the matter is resolved.

12. No Guarantee of Publication or Marketing Success

While we provide professional services aimed at assisting clients with publishing and marketing efforts, we do not guarantee that any work we produce will result in publication, sales, or other specific outcomes. Publishing success depends on various factors beyond our control, including market trends, timing, and audience preferences.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the state of Texas, without regard to conflict-of-law principles. In the event of any dispute, the parties agree to attempt mediation before pursuing litigation. Any legal action shall be brought in the state or federal courts of Texas, and the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
