Upon full payment for services, Writers of the West LLC sends final deliverables to the client, as stated in the contract sent by both parties. Book ownership and rights fully belong to the client for any work done at any stage of the process.
Writers of the West LLC shall not be liable for any claims of copyright infringement, defamation, or other legal issues arising from the client’s use of the deliverables.
5. User-Generated Content
If you submit manuscripts, documents, images, testimonials, or other materials to Writers of the West through our website, email, SMS, or other communication channels, you retain full ownership of your intellectual property and all associated rights.
You grant Writers of the West LLC a limited, non-exclusive, royalty-free license to use, reproduce, modify, and store such materials solely as necessary to provide the Services you have requested. This license automatically ends upon completion or termination of your project, except where limited retention is required by law, accounting obligations, dispute resolution, or backup and recordkeeping purposes. We will not publish, publicly display, distribute, or use your manuscript, project materials, or other confidential content for marketing or promotional purposes without your prior written consent. Testimonials and reviews voluntarily submitted for publication may be used in accordance with your authorization.

9. Refund Policy
While we are dedicated to ensuring your satisfaction, refunds are issued only under the following conditions:
- Dissatisfaction After Revisions:
If, after receiving revisions, you remain unsatisfied with the quality of our work and have clearly communicated specific concerns that were not addressed, you may be eligible for a partial refund of the amount paid. - Repeated Late Deliveries:
In cases where deadlines are missed on multiple occasions without prior notice or agreement, you may request a partial or full refund depending on the frequency and extent of the delays.
Important Note on Quality Concerns
If the refund request is related to a lack of quality, you must communicate your concerns during the project process, allowing us the chance to address and resolve the issue. If quality dissatisfaction is not clearly communicated in a timely manner, and you suddenly decide to cancel and request a refund, no refund will be processed.
Refunds Will Not Be Issued For:
- Change of scope or direction after work has commenced.
- Delayed responses, lack of communication, or indecision on the client’s part.
- Personal preferences or subjective changes that were not part of the original agreement.
- Any other reason not explicitly related to quality or timeliness.
10. Payment Disputes
Clients agree to make payments for services rendered in accordance with the agreed-upon payment schedule. In the event of a payment dispute or chargeback, Writers of the West LLC reserves the right to pursue legal remedies and will not be liable for any losses or damages incurred as a result of the dispute. Should a dispute arise, we encourage you to contact us directly to resolve the issue.
11. No Guarantee of Traditional Publication or Marketing Success
While we provide professional services aimed at assisting clients with publishing and marketing efforts, we do not guarantee that any work we produce will result in a traditional publishing deal, sales, or other specific outcomes. Publishing success depends on various factors beyond our control, including market trends, timing, and audience preferences.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the state of Texas, without regard to conflict-of-law principles. In the event of any dispute, the parties agree to attempt mediation before pursuing litigation. Any legal action shall be brought in the state or federal courts of Texas, and the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.
