Writers of the West LLC provides professional services in the areas of publishing, book marketing, and ghostwriting. By engaging with our services, you agree to the following terms and conditions:

Refund Policy

While we are dedicated to ensuring your satisfaction, refunds are only issued under the following conditions:

–   Dissatisfaction After Revisions: If, after receiving revisions, you remain unsatisfied with the quality of our work and have clearly communicated specific concerns that were not addressed, you may be eligible for a partial refund of the amount paid.

–   Repeated Late Deliveries: In cases where deadlines are missed on multiple occasions without prior notice or agreement, a   partial or full refund   may be requested depending on the frequency and extent of the delays.

If the refund request is in regards to a lack of quality of content, the author should mention it during the process, so the company has the rightful chance to amend the issue. But if the quality dissatisfaction has not been communicated clearly during the process and the author suddenly decides to cancel the contract and request a refund, a refund will not be processed.

Refunds will not be issued for the following reasons:

– Change of scope or direction after work has commenced.

– Delayed responses, lack of communication, or indecision on the client’s part.

– Personal preferences or subjective changes that were not part of the original agreement.

– Any other reason not explicitly related to quality or timeliness.

Service Completion and Limitation of Liability

Writers of the West LLC strives to complete all projects in accordance with client specifications. However, due to the subjective nature of creative work (including ghostwriting, editing, and publishing services), we cannot guarantee specific results, such as sales performance, ranking in search engines, or audience reception.

You acknowledge that the success of your project depends on various factors outside our control. Writers of the West LLC shall not be held liable for:

– Financial outcomes related to your project (such as book sales, royalties, or marketing impact).

– Any direct, indirect, or incidental damages arising from the use of our services, including loss of profits, opportunities, or reputation.

Intellectual Property Rights

Upon full payment for services, Writers of the West LLC transfers full ownership of the final deliverables to the client, unless otherwise agreed upon in writing. Until payment is made in full, Writers of the West LLC retains all intellectual property rights to the work produced.

Clients are solely responsible for ensuring that their use of our services complies with any applicable copyright, intellectual property, or privacy laws. Writers of the West LLC shall not be liable for any claims of copyright infringement, defamation, or other legal issues arising from the client’s use of the deliverables.

Payment Disputes

Clients agree to make payments for services rendered in accordance with the agreed-upon payment schedule. In the event of a payment dispute or chargeback, Writers of the West LLC reserves the right to pursue legal remedies and will not be liable for any losses or damages incurred as a result of the dispute.

Should a dispute arise, we encourage you to contact us directly to resolve the issue. If chargebacks are initiated without prior communication, all rights to the work provided will immediately revert to Writers of the West LLC until the matter is resolved.

No Guarantee of Publication or Marketing Success

While Writers of the West LLC provides professional services aimed at assisting clients with their publishing and marketing efforts, we do not guarantee that any work we produce will result in publication, sales, or any other specific outcomes. Publishing success depends on various factors beyond our control, including but not limited to market trends, timing, and audience preferences.

Governing Law and Dispute Resolution

This agreement is governed by the laws of the state of Texas. In the event of a dispute, the parties agree to attempt mediation before pursuing litigation. Any legal disputes will be resolved in the state or federal courts of Texas, and the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs.

Changes to Terms

Writers of the West LLC reserves the right to amend these terms and conditions at any time. It is the responsibility of the client to review these terms periodically to ensure ongoing compliance.
